N O T I F I C A T I O N 

In exercise of the powers conferred by clause (n) of sub-section (2) and sub-section (3) of section 8 read with section 7 of the Sikkim (Repeal and Miscellaneous Provisions) Act, 1985, the State Government hereby makes the following rules further to amend the Sikkim Regulation for display of Advertisement Rules, 1987, namely: - 

Short title,                  1.            (1)    These  rules  may  be  called  the  Sikkim  extent and                                           Regulation for Display of Advertisement commencement.                                (Amendment) Rules, 2001. 

(2)              They extend to the whole of Sikkim. 

(3)              They shall come into force at once. 

2.                  In the Sikkim Regulation for Display of Advertisement Rules, 1987 (hereinafter referred to as the said rules), rule 2 of the said rules shall be re-numbered as sub-rule (1) of that rule and after sub-rule (1) as so renumbered, the following sub-rule shall be inserted, namely: - 

“(2) If any Department whether belonging to the Central or State Government proposes to display any advertisement in their property, building, road reserve or installation etc. belonging to them, such department or authority shall seek the permission of the Urban Development and Housing Department failing which the advertisements shall be removed without prior notice.” 

3.                  In the said rules, after rule 3, the following rules shall be inserted, namely: - 

“3A. Restriction to display advertisement in Government building, flyovers, Government parks etc. 

(1) No display of any advertisement, banners, hoardings, festoons, posters, etc. shall be allowed in any flyover, Government Buildings/Institutions, Government Parks and other properties etc. except in areas designated by the Urban Development and Housing Department in Schedule - I. 

(2)              The following places at Gangtok shall be used exclusively for the purpose of postering and advertisement by Government Departments and Political parties, - 

(a)               Plastered wall along the National Highway opposite to the State Bank of Sikkim Building. 

(b)              Plastered wall on the back side of the State Bank of Sikkim Building along the P.S. Road. 

(c)              Plastered wall below the Government food godown on the way to Lall Market. 

(d)              Plastered wall below Lall Market Road near L.D. Kazi Bridge. 

(e)              No hoarding shall be allowed on the valley side of the road.” 

“3B. Restriction to use plastic and other non-biodegradable material for advertisement purposes. 

Use of any poster, banner or advertisement etc. made out of plastic and other non-biodegradable materials shall not be allowed.” 

“3C. Some other provisions relating to advertisement. 

(1)              The size of banner/festoon for advertisement shall be 12 ft. by 3 ft. and size of hoarding shall be 6 ft. by 5 ft. 

(2)              For installation of any hoarding along the National Highway, clearance of the Forest Department as well as the GREF shall invariably be necessary. 

(3)              Every hoarding, banner, festoon, poster etc. shall mention the name of the individual, organisation or institution displaying it.” 

4.                  In the said rules, in rule 4, for sub-rules (2) and (3), the following shall be substituted, namely: - 

“(2) If the party fails to remove the hoarding, festoons, banners etc. within 24 hours from the time of instruction, they shall be removed by the Department without any Notice to the party concerned and the materials confiscated. 

(3) The content of the advertisement shall be such as will not attract any criminal proceedings or legal action under any existing law, rules and regulations etc.  The responsibility in regard to the contents of the Banner/hoardings/posters shall lie with the individual or organisation or institutions displaying the banner.” 

5.                  In the said rules, after rule 4, the following rules shall be added, namely: - 

“5. Renewal of conditions of permission. 

(1)              An application for renewal/extension of permission shall invariably be made before the expiry of the period of existing permission.

(2)              Any application for renewal/extension of permission submitted after the expiry of the period for which permission was previously granted shall be accompanied by a late fee of Rs.5/- for each day of delay.  The permission shall be deemed to be in force during the pendency of the disposal of the renewal application. 

(3)              Where the authority empowered to issue permission for display of hoardings, banners etc. is of the opinion that the proposed or existing site for any advertisement is not suitable in the interest of public safety, traffic hazards or aesthetics, he may reduce the number of advertisement in a particular location to avoid visual pollution or refuse to grant any new permission or renew any existing permission. 

“6. Penalty - 

Whosoever commits any offence by contravening or failing to comply with any of the provisions of these rules or any direction lawfully given or any requisition lawfully made under these rules shall be punished with fine amounting to Rs.3,000/- which may extend to Rs.5,000/- (Rupees Five thousand) only.” 

In the said rules, in Schedule – I, under the heading conditions of permission, - 

(i)                in serial number 6, for the word and figure “Rs.500/-,” the words and figure “Rs.5,000/-” (Rupees five thousand) shall be substituted; 

(ii)             after serial number 6, the following shall be inserted, namely: - 

“7. The duration of the permission and reference granting the permission shall be displayed in the advertisement.” 

7. In the said rules, for Schedule – II, the following Schedule shall be substituted, namely: -
